Switzerland Approves First Spot Bitcoin ETF for Retail Investors After Bending Its Rules

The Swiss Financial Market Supervisory Authority (FINMA) has approved the country’s first spot Bitcoin (BTC) ETF for retail investors. To clear it, the regulator waived its own diversification rules.

FINMA kept the issuer’s name confidential. Zurich-based BIT Asset Management later claimed the approval, planning a November listing on SIX Swiss Exchange under the ticker BBIT.

The news spread quickly on social media, where some accounts touted the size of Switzerland’s wealthy retail base.

Why Did FINMA Bend the Rules for a Spot Bitcoin ETF?

Swiss law normally requires public funds to spread money across many holdings. A single-asset fund breaks that rule by design.

FINMA justified the exemption by citing Bitcoin’s long trading history and high volume relative to other cryptocurrencies.

The decision goes beyond FINMA’s 2021 approval of a crypto basket fund. That product, launched by the firm now called BIT Asset Management, was limited to qualified investors.

Swiss exchanges already list physically backed Bitcoin exchange-traded products (ETPs). However, those are debt-like securities, not funds governed by Swiss collective investment law.

Local appetite already exists. Some Swiss managers pair Bitcoin with gold and the franc as a hedge against mounting US debt.

“Investors can now access bitcoin through an ordinary Swiss bank account, with Swiss fund governance, independent custody…”

Dominik Oggenfuss, CEO of BIT Asset Management, said in the firm’s announcement.

Can Fund Rules Make Bitcoin Safe Enough for Retail?

Supervised firms must contain custody and operational risks under FINMA guidance published on January 12, 2026.

Sellers must also follow the Financial Services Act (FinSA), Switzerland’s point-of-sale conduct law. That means volatility warnings and suitability checks for buyers.

“…investments in Bitcoin – even through an approved ETF – remain highly risky.”

FINMA added the warning in its statement, noting investors could lose a significant share of their capital.

BIT has not disclosed the fund’s fee, custodian, or retail distribution partner. Meanwhile, FINMA said other providers have already filed or announced Bitcoin ETF applications.

The approval also lands as ETF demand recovers. Digital asset funds suffered a record run of outflows earlier this year. However, US spot Bitcoin ETFs drew $526.6 million in inflows on October 19.

BIT already markets BBIT as Europe’s only spot Bitcoin ETF. Rival filings will soon test whether that claim, and the exception behind it, holds.
