California Politicians Won’t Be Able to Launch Meme Coins. Newsom Just Signed the Ban

On September 27, Governor Gavin Newsom enacted Assembly Bill (AB) 2409, prohibiting public officials in California from creating meme coins.

Furthermore, the legislation blocks cryptocurrency platforms from selling new meme coins associated with public officials to residents of California. The administration of Governor Newsom positioned this legislative package as a direct countermeasure to President Donald Trump’s digital token.

Who AB 2409 Puts Off-Limits

In February, Anaheim Democratic Assemblymember Avelino Valencia brought the bill forward. The Senate approved it unanimously with a 40-0 vote in August, and the Assembly subsequently passed the final text 78-0.

The prohibition applies to state and local elected and appointed leaders, encompassing legislators alongside advisory board members. Public employees who hold decision-making authority regarding contracts and bids are likewise included.

Beginning January 1, 2027, cryptocurrency exchanges will encounter a distinct restriction preventing them from offering new meme coins connected to local, state, or federal officials to California buyers.

A Senate Judiciary Committee analysis noted that this implementation date permits older assets, such as Official Trump (TRUMP), to remain on trading platforms. Consequently, early investors retain the ability to liquidate holdings if a price surge allows them to mitigate previous losses.

Enforcement authority rests with the Attorney General, who may pursue injunctions and financial disgorgement. Additionally, county counsel, city attorneys, and district attorneys possess the power to enforce the restrictions against officials.

During the announcement, Newsom explicitly tied the legislation to Trump.

“While the scam that is Donald Trump continues to hurt American families, California is fighting to make our economy work for people, not the powerful,” he said.

From the White House to Bangui

The state-level prohibition arrives in the wake of several meme-based tokens introduced or endorsed by national figures and a former mayor, all of which experienced steep declines in value following their initial launches.

Three days prior to his second inauguration in January 2025, Trump released TRUMP. Newsom’s administration highlighted a July investigative report from The New York Times concerning the Official Trump (TRUMP) asset.

The publication revealed that roughly 1 million individuals purchased the token and collectively sustained losses exceeding $3 billion, whereas Trump himself accumulated approximately $636 million in profits. Market statistics from BeInCrypto indicated that TRUMP traded at $2.09, representing a 97.2% drop from its all-time high.

In a similar vein, Central African Republic President Faustin-Archange Touadéra debuted the Central African Republic Meme (CAR) in February 2025. Described as an initiative to bring people together and elevate the nation’s visibility, market metrics showed the coin had fallen 99% from its peak valuation.

Eric Adams, the former mayor of New York City, introduced the NYC Token (NYC) during a Times Square event in January 2026. Although its market capitalization approached $600 million, it subsequently plummeted by roughly 80%.

Additionally, Argentine President Javier Milei faced similar scrutiny in February 2025 after endorsing the LIBRA token, which suffered a rapid collapse soon afterward.

Meme Coins Join California’s Growing List of Off-Limits Bets

While AB 2409 does not retroactively target those previously issued tokens, its exchange listing rules do encompass federal officials. The measure builds upon prior ethical regulations enacted by the Newsom administration.

California public servants are already mandated to publicly disclose cryptocurrency investments. Furthermore, Newsom implemented a rule in March prohibiting appointees within the Governor’s Office from leveraging nonpublic data for financial gain on prediction markets.

Federal lawmakers in Washington have taken comparable steps; the US Senate passed a resolution in April that bars senators from engaging in prediction market trading.
